CONSIDERANDO: Que el artículo 60 de la Constitución de la República consagra el
derecho a la seguridad social y establece que “el Estado estimulará el desarrollo progresivo
de la seguridad social para asegurar el acceso universal a una adecuada protección en la
enfermedad, discapacidad, desocupación y la vejez”.
CONSIDERANDO: Que la Ley núm. 590-16, del 15 de julio de 2016, Orgánica de la Policía
Nacional, establece el sistema para un retiro digno de los miembros del cuerpo policial.
CONSIDERANDO: Que el artículo 115 de la referida ley le atribuye al presidente de la
Republica, previa recomendación del Consejo Superior Policial, la facultad de otorgar
pensiones a los miembros de la Policía Nacional puestos en condición de retiro por
antigüedad en el servicio, edad y por discapacidad.
CONSIDERANDO: Que el 13 de marzo de 2023, el Consejo Superior Policial aprobó
mediante la Resolución núm. CSP-2023-03-002, recomendar al Poder Ejecutivo ascender al
rango superior inmediato y colocar en honrosa situación de retiro por haber alcanzado el
tiempo máximo de permanencia en el grado, por edad o antigüedad en el servicio y colocar
en honrosa situación de retiro por haber alcanzado el tiempo máximo de permanencia en el
grado, por edad o antigüedad en el servicio, con disfrute de pensión, a varios miembros de la
Policía Nacional.
VISTA: La Constitución de la República Dominicana, proclamada el 13 de junio de 2015.
VISTA: La Ley núm. 87-01, del 9 de mayo de 2001, que crea el Sistema Dominicano de
Seguridad Social, y sus modificaciones y normas complementarias.
VISTA: La Ley núm. 590-16, del 15 de julio de 2016, Orgánica de la Policía Nacional.
VISTO: El oficio del director de la Policía Nacional núm. 7607, del 13 de marzo de 2023,
dirigido al presidente de la República, mediante el cual le remite la resolución del Consejo
Superior Policial correspondiente a la segunda reunión ordinaria del Consejo Superior
Policial.
En ejercicio de las atribuciones que me confiere el artículo 128 de la Constitución de la
República, dicto el siguiente
DECRETO:
ARTÍCULO 1. Se colocan en honrosa condición de retiro por haber alcanzado el tiempo
máximo de permanencia en el grado, por edad o antigüedad en el servicio con ascenso al
rango superior inmediato y se les otorga una pensión del Estado dominicano a los siguientes

ARTÍCULO 3. El pago de las presentes pensiones se hará conforme a los procedimientos
establecidos en la Ley núm. 590-16, Orgánica de la Policía Nacional, del 15 de julio de 2016.
ARTÍCULO 4. Se dispone que el pago de toda pensión otorgada por el Poder Ejecutivo, con
cargo al Fondo de Pensiones y Jubilaciones de la Ley de Presupuesto General del Estado,
tenga efectividad a partir de la fecha en que el beneficiario formalice su solicitud de inclusión
en la nómina de los jubilados y pensionados civiles del Estado ante la Dirección General de
Jubilaciones y Pensiones a cargo del Estado del Ministerio de Hacienda.
PÁRRAFO. La Dirección General de Jubilaciones y Pensiones a cargo del Estado tendrá un
plazo de tres (3) meses para hacer efectivo el pago de las pensiones, contados a partir de que
el interesado haya tramitado su solicitud de inclusión a la nómina de pensionados. El pago
de la pensión se considerará efectivo y con derecho a pago retroactivo luego de cumplido
dicho plazo.
ARTÍCULO 5. Envíese a las instituciones correspondientes para su conocimiento y
ejecución.

Dec. núm. 122-23 coloca en situación de retiro voluntario y asciende al rango superior
inmediato a 14 miembros de la Policía Nacional y les concede la pensión
correspondiente, así como también retira voluntariamente a 687 oficiales superiores y
subalternos de esa institución con disfrute de dicha pensión. Retira además a 20
miembros de la citada institución por discapacidad, con ascenso al rango superior
inmediato y les otorga sus pensiones. Pone en retiro por discapacidad a 27 miembros
de la Policía Nacional y les concede la pensión de acuerdo a la ley. G. O. No. 11104 del
